Indio Traffic Accident Personal Injury Attorneys

indiocalifornia.jpgThe City of Indio has seen consistent population growth over the years. Since the previous census, the number of Indio residents swelled 54.8% to 76,036 at the time of the 2010 Census. Thousands of visitors flock to Indio for annual music festivals like Coachella and Stagecoach, as well as enjoy the camping grounds available near by. And like any other large city, Indio is the site of hundreds of motor vehicle accidents, causing serious injury and fatality. In 2009, there were 5 fatal accidents and 176 injury accidents on Indio's roadways. Some of the locations of fatal accidents include:

  • State Route 111
  • Jackson Street
  • Pacific Street
  • Interstate 10.

If you or a loved one has been involved in a serious car accident as result of someone else's careless actions, you may be entitled to compensation. Please consult our Indio traffic accident attorneys to ensure your rights are fully protected.

Truck Accidents in Indio

Riverside County has one of the highest numbers of truck accidents in California. Because the Interstate 10 bisects the County, thousands of trucks crossing the State or country pass through Riverside and Indio. As the fourth longest highway in the United States, Interstate 10 is a major route for transportation. The high number of commercial trucks means a greater chance for a serious truck accident to occur. A trailer truck can outweigh a passenger vehicle by over 76,000 pounds. A collision with a large vehicle can result in catastrophic injuries for the occupants of the smaller car. Some of the most common causes of truck accidents include:

  • Fatigued driving
  • Speeding
  • Distracted driving
  • DUI/DWI
  • Unsafe lane changes and turns
  • Sudden stops.

Recovering Compensation

Not all accidents require assistance from a personal injury lawyer; smaller claims can be settled without professional intervention. Paramedic Killed in Ambulance Crash on Interstate 10

I-10.pngONTARIO - A 23-year-old paramedic was killed in an ambulance crash early Sunday morning on Interstate 10, the Press-Enterprise reported. According to news accounts, 23-year-old Doug Odgers was a front passenger and paramedic in an ambulance travelling westbound on I-10 when, for unknown reasons, the vehicle struck a freeway sign pole east of the Fourth Street onramp. Paramedics responded and transported Odgers to San Antonio Community Hospital where he died of his injuries just after 9 a.m. No patients were being transported at the time of the accident, which occurred at 6:10 a.m. on May 8, 2011.

Cause of the May 8th Ontario Ambulance Accident

The Press-Enterprise reported that a preliminary investigation by the CHP did not reveal the cause of the San Bernardino County accident. The ambulance, a 2007 Ford, was driven by 25-year-old Grelli Ugarte of Carmarillo. Carmarillo suffered moderate injuries and was taken to Arrowhead Regional Medical Center. Hopefully, the CHP investigation will reveal exactly what happened and why.

Ambulance Accident Wrongful Death Liability

Based on the limited information in news accounts, it appears that, as a passenger, Odgers could have done little to prevent this accident from occurring. If it is determined that the driver of the ambulance caused the crash, or if the accident was caused by a defect in the ambulance or due to deferred maintenance, the owner / operator of the medical transport company may be liable for the wrongful death of the paramedic. After a fatal accident such as this one, the family members of the victim would be well-advised to speak with an experienced and knowledgeable California wrongful death lawyer who is familiar with the unique legal issues of medical transport accidents. An attorney can advise the family of their best course of action to protect their legal rights following this accident, and help them fully hold accountable whoever is responsible for their loved one's death.

It is not clear if the ambulance had sirens activated, or how fast the vehicles were going when they collided. The cause of the incident remains under investigation.

Medical Transport Provider Wrongful Death Liability

Medical transport companies are considered "common carriers" - because they advertise their services to the general public and accept payment for their transportation services. Under the California Civil Code, "a carrier of persons for reward must use the utmost care and diligence for their safe carriage, must provide everything necessary for that purpose, and must exercise to that end a reasonable degree of skill."

Regardless of whether this accident was the fault of the ambulance driver, or the driver of the other vehicle, the family members of the victim may have legal rights to compensation for the loss of their loved one in this horrific crash.

After an accident such as this one, the family members of the victims may benefit from speaking to a lawyer who has represented victims of medical transport accidents and their families. Common carrier accidents have very unique legal issues, and it is important to understand the victim's family's legal rights and options. It is always advisable to talk to a Riverside personal injury lawyer before providing a statement to an insurance adjustor or accepting any insurance settlement offer. Head-on Collision Wrongful Death Liability

If the driver of the Isuzu is determined to have caused this fatal crash, he or she may be liable for the wrongful death of Phyllis Clemons. Mother and Two Children Struck by Tow Truck Driver in Oxnard Crosswalk

simon-vineyard.jpgA tow truck driver was arrested Tuesday afternoon after striking a mom and her two young children in a marked crosswalk in Oxnard. The accident occurred at the intersection of Vineyard Boulevard and Simon Way. According to police, the tow truck driver was turning left from westbound Simon Way to southbound Vineyard Avenue on a green light. The young mother, Alma Lopez, 19, was pushing her stroller across Vineyard on a green light in a marked crosswalk. Lopez was struck by the tow truck, driven by Mehran Khamseh, 45, of Santa Barbara, and thrown to the ground, and the stroller was pinned under the flatbed truck and dragged more than a quarter of a mile. The accident occurred at about 12:07 p.m. Tuesday.

Lopez suffered moderate injuries and her two children, a 3-year-old girl and a 1-year-old boy, suffered critical injuries. They were treated at Ventura County Medical Center. Khamseh was later arrested on suspicion of driving under the influence of drugs. According to the Ventura County Star, Khamseh was held in jail without bail on suspicion of DUI, parole hold and immigration hold. Court records showed several prior traffic infractions. Khamseh was also convicted in 2008 of making terrorist threats and petty theft with a prior, both felonies.

Cause of the Major Injury Crash

The Oxnard Police Department is still continuing their investigation. Anyone with information about this major injury collision is asked to contact Officer Maria Pena of the Oxnard PD at 805-385-7750. However, if news reports are accurate, this crash was almost certainly caused by the driver of the tow truck.

Three People Injured in Big Rig Crash on Interstate 5 in Valencia

interstate-5-newhall-eb.jpgThree people were injured, including one critically, Friday morning in a crash on Interstate 5 north of Los Angeles, Mercury News reported. The crash, which occurred in the northbound lanes of the freeway in the Valencia area at about 11:17 a.m., involved a small car being involved between two trucks. Based on the limited information provided in news reports, it is not clear how this crash occurred or who was at fault. The California Highway Patrol is investigating.

This accident is just another example of the severe damage a tractor-trailer can cause. Semi-trucks can weigh up to 40 times more than a small passenger vehicle, and are responsible for several hundred fatal accidents and more than 3,000 injury accidents each year in California alone. We hope the three injured parties involved in this crash make a full and quick recovery from their serious injuries sustained in this July 30th truck accident.

Who Can Be Held Responsible for a Truck Accident?

In accidents involving only passenger vehicles, most of the time fault and liability is attributed to one of the drivers. However, in trucking accidents, there are often multiple parties that may be liable, including the truck driver, the trucking company, the manufacturer of the truck or truck parts, the company or individuals responsible for maintaining the truck, the shipping company, and others. It is always a good idea to contact an attorney soon after any accident; however, in truck accidents, it is especially important. The trucking company will fight liability and do everything to limit the amount of compensation a victim ultimately receives, including presenting evidence to suggest an injured party is responsible for a crash.

Truck Accidents and Personal Injury Liability

The injured victims of this accident would be well-advised to contact an experienced Los Angeles truck accident attorney as soon as possible who can review the accident report and advise of their legal rights and options to pursue compensation in a personal injury claim. Accidents involving big-rigs and semi-trucks have very unique legal issues due to the federal laws governing the trucking industry. A skilled truck accident lawyer can advise the victims of their best course of action following this crash to ensure they receive the maximum, full and fair compensation for their injuries.

Cause of the Fatal Bicycle Accident

The cause of the accident is still under investigation. Police said it was not evident if the truck struck the bicyclist or the bicyclist collided with the truck. However, the Corona Del Mar Today reported that a gardening truck pulled in front of Mike Nine, causing him to swerve and crash. Anyone with information about this accident is asked to contact Newport Police investigator Todd Bush at (949) 644-3746.

Bicycle Accidents and Wrongful Death Liability

Understanding the causes of bicycle accidents and the liability concerns that arise from them requires unique perspective. While this crash is under investigation, the family of the victim would be well-advised to contact an experienced bicycle accident attorney. While many personal injury attorneys claim to handle bicycle accidents, an attorney who is also a cyclist may be a huge benefit in this situation. A skilled lawyer who specializes in cycling accident injury and wrongful death claims and understands the dynamics of sharing the road with negligent motorists can help the family protect their legal rights and hold whoever is responsible for this fatal accident fully accountable for the wrongful death that occurred as a result of it.
