More than 1.4 Million Packages of Birth Control Are Recalled Due to Packaging Error

birthcontrol2.jpgOn September 16, 2011, the U.S. Food and Drug Administration (FDA) announced a massive birth control recall due to a packaging error that may leave women at risk for an unplanned pregnancy. More than 1.4 million packs of affected birth control pills, manufactured by Qaulitest Pharmaceuticals, have been distributed to women over the last year and include Cyclafem 7/7/7, Emoquette and Previfem. The FDA is advising women to reference the lot number located at the bottom of the box or blister pack with the lot numbers listed here. Women taking one of the affected pills should immediately being using a non-hormonal form of birth control. Currently, the faulty packaging poses no immediate health risks. Consumers who have had an adverse reaction or quality issue with one of the affected products should contact Qualitest toll free at (877) 300-6153 or contact the FDA online.

Qualitest Pharmaceuticals, a subsidiary of Endo Pharmaceuticals, is currently investigating the source of the packaging error. Large pharmaceutical companies like Qualitest have a responsibility to provide consumers with products that work as advertised. Woman and Child Killed in Interstate 15 Crash Near Nevada State Line

interstate15nipton.jpgSAN BERNARDINO COUNTY - A 50-year-old woman and an 11-year-old girl were both tragically killed Sunday night in an SUV rollover crash in Mountain Pass on Interstate 15, the San Bernardino Sun reported. The July 17th accident was reported at 10:18 p.m. on northbound I-15, north of Yates Well Road, west of Nipton, CA and south of Primm, NV. Paramedics found a silver 1999 Isuzu Rodeo had overturned into a ditch. The Sun reported two people died at the scene and the driver and two other passengers were taken to University Hospital in Las Vegas. The fast lane of I-15 was closed for five hours while CHP officers conducted an investigation.

The San Bernardino County Sheriff-Coroner identified the victims as Patricia Vargas, 50, of Las Vegas, and Maria Lopez, 11, of Mexico. According to the press release, both victims were not wearing seat belts and were ejected from the vehicle when it overturned after the tread on one of the vehicle's tires separated, causing the driver to lose control.

Interstate 15 Rollover Accidents

Interstate 15 in San Bernardino County has been the location of dozens of serious injury or fatal vehicle rollover accidents over the years. Just last month, two Nevada woman were killed in an Interstate 15 rollover accident near Baker. In May, a 37-year-old Los Angeles man died in a SUV rollover crash in the Cajon Pass. Consumer Reports Cautions of Toning Shoe Injury Risks

According to an article last week in Consumer Reports, Americans spent more than $1 billion on toning shoes in 2010, up from about $360 million the previous year.

Critical Injuries Reported in School Van Rollover on Interstate 10

vanrolloveri10.jpgTHOUSAND PALMS - Six people were hospitalized following a minivan rollover crash Thursday morning on westbound Interstate 10, near Cook Street, KPSP Local 2 News reported. The accident, involving a 2002 Mercury van registered to the Coachella Valley Unified School District, occurred around 8:49 a.m. on Thursday, March 24, 2011. According to the CHP, six people were injured in the crash. Two people suffered critical injuries, two people suffered moderate injuries, and two people suffered minor injuries. The occupants included a high school student, parent and staff of Coachella Valley Unified, and were part of a caravan of vehicles headed to Ontario International Airport, where the group would fly to Sacramento and then visit California State University Chico.

Due to the accident, the trip was cancelled, and the 23 students scheduled to visit the university would not get to go.

Cause of the Interstate 10 Rollover Crash

KPSP News reported that the driver of the vehicle following the van reported seeing a tire blowout before the driver lost control of the vehicle and the fan overturned. Tire blowouts can be attributed to many causes, including deferred maintenance of aging, worn tires, cargo overloading, underinflation, roadway hazards (such as potholes and debris), excessive speed, and manufacturing defects. Additionally, defective tire repairs can allow moisture to penetrate the tires and rust the steel belts. This could lead to rusting and increase the likelihood of tire failure. The CHP will likely have the tire inspected to determine if the crash was caused by a defect in the tire.

North Las Vegas Man Killed in Polaris Razor Rollover Accident

A New Year's Eve ATV accident tragically took the life of a 37-year-old North Las Vegas man, the San Bernardino County Sheriff-Coroner Department reported. The accident happened at about 10:00 p.m. on December 31, 2010, in the Dumont Dunes area of Rural Baker, Cactus Thorns reported. The victim was identified as Jesus Ruiz. According to reports, Ruiz lost control of a Polaris Razor in the open desert. The Razor overturned and Ruiz was ejected from the vehicle. Ruiz was pronounced dead at 10:30 p.m. The cause of the incident remains under investigation by the California Highway Patrol.

Las Vegas Woman Killed in I-15 Rollover Crash Near Baker

interstate-15.jpgA 61-year-old Las Vegas woman tragically died in a vehicle rollover crash Wednesday morning on Interstate 15, the San Bernardino County Sheriff-Coroner reported. The woman, Christine Ann Newton, was a right rear passenger in a 2007 Ford F-150 travelling northbound on I-15. About one mile north of ZZyzx Road, at about 8:48 a.m. on November 3rd, the driver of the truck she was riding in lost control and struck the center divider. The driver apparently overcorrected, and then jerked the wheel back to the right. The vehicle overturned and Newton, who was wearing a seat belt, was partially ejected and died at the scene of the crash. It is unclear if anyone else in the vehicle was injured.

Cause of the I-15 Crash

The cause of the fatal Interstate 15 accident remains under investigation by the California Highway Patrol - Barstow Station. Based on the news reports, it is unclear what caused the driver of the vehicle Newton was riding in to lose control and crash. As a restrained passenger in the backseat of the vehicle, Newton likely could have done nothing to prevent this horrible crash that ultimately ended her life. Jury Awards $21 Million to Woman Blinded by Anti-Inflammatory Drug

money-justice.jpgIn product liability news, earlier this month a federal jury in New Hampshire awarded $21 million to a woman who suffered severe burn injuries and blindness after taken the anti-inflammatory medication Clinoril (sulindac) for shoulder pain. The jury found, after deliberating for three days, that the manufacturer of Clinoril, Mutual Pharmaceutical Co., should have known the dangers of the drug. According to the plaintiff's attorneys, the jury's verdict was the largest award in a New Hampshire product liability lawsuit.

The plaintiff, Karen Bartlett, 51, spent 112 days in five hospitals, including the burn unit at Massachusetts General Hospital. She was diagnosed with Stevens-Johnson Syndrome and toxic epidermal necrolysis. She is legally blind, despite having undergone 12 eye operations. Mutual Pharmaceutical argued that the drug has been approved by the FDA for 32 years. The judge presiding over the case instructed jurors that in order for them to hold Mutual liable, they had to find the drug unreasonably dangerous and the underlying cause of Bartlett's condition.

Tire Blowout Blamed for Fatal I-15 Rollover Accident

I-15.pngThe Press-Enterprise has reported a tire blowout is likely to blame for a fatal solo-vehicle accident over the weekend on Interstate 15. The accident occurred on southbound Interstate 15, north of Baseline Road, at about 5:15 p.m. Sunday, September 19, 2010. According to news reports, Vannity Joy Lewis, 18, of Fontana was a passenger in a 1997 Volkswagen Jetta travelling southbound on Interstate 15. One of the rear tires on the vehicle blew out, causing the driver to lose control of the car.

The Jetta overturned multiple times, and Lewis was ejected from the vehicle and died at the scene of the crash. The driver and one other passenger suffered major injuries. Two other passengers suffered moderate injuries.

Cause of the Interstate 15 Crash

The California Highway Patrol is continuing to investigate the cause of the accident. If news reports in the Press-Enterprise and Fontana Herald News are accurate, this accident was likely caused by a tire blowout, a common vehicle malfunction that can lead to a serious car accident. Major Injuries in Jeep Grand Cherokee Rollover Near Barstow

The solo-vehicle accident, which involved a Jeep Grand Cherokee, occurred near the intersection of CA State Route 58 and Interstate 15. According to the CHP, the tread separated on one of the rear tires on the Jeep, causing the driver of the vehicle to lose control and veer off the freeway. Two of the occupants in the vehicle suffered major injuries and were airlifted to Arrowhead Regional Medical Center; two others with less serious injuries were taken by ambulance to Barstow Hospital. The California Highway Patrol is investigating the cause of the San Bernardino SUV rollover accident.

Bloomington Woman Killed, Man Injured in Interstate 15 Rollover Crash

A Bloomington woman died Monday morning in a solo vehicle rollover accident on Interstate 15 in Victorville, the San Bernardino Press Enterprise reported. The July 5th accident was reported at 7:51 a.m. on northbound I-15, north of Bear Valley Road in Victorville. The San Bernardino County Coroner identified the victim as Gloria Lynn Hooker, 57, of Bloomington.

According to the Victorville Daily Press, Hooker was a passenger in a 1999 Ford F250 Superduty pickup truck driven by Jerry Wayne Hooker, 55. The vehicle was in the fast lane when one of the tires rapidly lost pressure. As the driver attempted to pull over in the center divider, the tire shredded, causing the pickup truck to overturn multiple times. Both the driver and the passenger remained in the vehicle and had to be extricated by emergency personnel. Jerry Wayne Hooker was flown to Antelope Valley Hospital with moderate injuries. Gloria Lynn Hooker died at the scene.

Tire Blowouts and Rollover Accidents

The California Highway Patrol is still investigating the cause of the accident. If news reports are accurate, the rapid deflation and blowout of the tire caused the driver of the vehicle to lose control, and the vehicle to overturn. This was not the first I-15 rollover fatality attributed to a tire blowout this year. A 46-year-old San Bernardino woman died in March in a Jeep rollover accident on I-15 attributed to a tire blowout.

Five Injured After Tire Blowout Causes Rollover Crash on Interstate 10

tireblowouteb.jpgFive people were injured in a rollover crash on Interstate 10 Wednesday afternoon, the California Highway Patrol reported. The injury accident was reported at 4:23 p.m. on Interstate 10 at Frontage Road, east of the Cactus City Rest Area in Chuckwalla. According to KPSP Local 2 News, the vehicle rollover was triggered by a tire blowout on the freeway. Firefighers extricated five people from the car. One person suffered critical injuries and was airlifted to a hospital. Two others suffered moderate injuries and two others suffered minor injuries.

Tire Blowouts and Accidents

By definition, tire blowouts are a rapid loss of air pressure in a tire, usually caused by a tire bursting or falling apart. With advances in tire technology, blowouts are less common than they were several decades ago, but these events still occur. Blowouts can occur for a number of reasons ranging from debris in the road, under inflation of a tire, or a small puncture that allows a tire to slowly deflate until it fails. Passenger Killed in Crash on Highway 154 Near Windy Gap

CA-154.pngOne person died in a solo-vehicle crash early Thursday morning in Santa Barbara County, authorities have reported. The fatal rollover crash occurred in the Windy Gap area on Highway 154 (the Chumash Highway), about a half-mile south of Painted Cave Road, and involved a 2006 Dodge Dakota pickup truck. According to reports of the incident, the driver and passenger were travelling from Malibu on their way to Chumash Casino in Santa Ynez.

Around midnight, the driver, Bert Barrera, 38, swerved to avoid some rocks that had fallen in the roadway, and struck another rock that was concealed by brush, causing him to lose control of the pickup truck. The vehicle crashed into a hillside and overturned. The rollover caused the roof to cave in and fatally injured the front seat passenger, a 45-year-old Malibu man who was not identified. Barrera suffered minor to moderate injuries. According to the CHP, alcohol was not a factor in the crash, and both men were wearing seat belts.

Cause of the Crash & Liability Issues

Although the cause of the accident is still under investigation, if news reports are accurate, the crash occurred because the driver did not see the rocks in the roadway. It is unclear how fast the pickup truck was travelling when the accident occurred, and if the driver could have prevented the collision. The passenger's death was likely caused by the roof of the pickup truck caving in and fatally crushing him. This accident raises a number of concerns from a legal standpoint. One, how long had the rocks been in the road, and did Caltrans know they were in the road before the accident occurred? If Caltrans was aware of the rocks, but failed to remove the rocks from the road in a reasonable amount of time, or if they were aware that rocks had fallen in the area in the past, Caltrans could be liable for the dangerous road condition.

Secondly, could the pickup truck have been better designed to prevent the passenger's death in this accident? Pickup truck rollovers often result in fatality or catastrophic injury because their roof and roof pillars may collapse. Because pickup trucks are not classified as "passenger vehicles," they are not subject to the same federal safety standards imposed on cars, even though they are marketed as passenger vehicles. Pickup truck rollovers, although not as common as SUV rollovers, may be subject to the same legal issues and remedies. Emergency avoidance maneuvers such as the one described in this April 29th accident on State Route 154, are common causes of pickup truck rollovers.

Wrongful Death Liability

LA Times: Toyota Expands Floor Mat Recall to Gas Pedals

Today, the Los Angeles Times reported that Toyota Motorcorp will either reconfigure or replace more than 3.8 million gas pedals on Toyota and Lexus vehicles included in a recall announced on September 29, 2009. Toyota initially believed the floor mats in these vehicles could cause the accelerator gas pedal to become "stuck", causing the vehicles to accelerate suddenly.

Beginning in January 2010, Toyota and Lexus owners will be able to take their car to a local dealer for gas pedal reconfiguration or replacement. In some of the vehicles, specifically the Lexus ES 350, Toyota Camry and Toyota Avalon, the shape of the floor surface will also be reconfigured to make additional space between the gas pedal and the floor. Additionally on the Toyota Camry, Toyota Avalon, Lexus ES 350, Lexus IS 350 and Lexus IS 250, Toyota Motor Corp will install a brake override system to cut engine power when the gas pedal and brake pedal are applied simultaneously.

The recalled vehicles include 2007-2010 Toyota Camry, the 2004-2009 Toyota Prius, the 2005-2010 Toyota Avalon, the 2005-2010 Tacoma, the 2007-2010 Toyota Tundra, the 2007-2010 Lexus ES 350 and the 2006-2010 Lexus IS 250 and IS 350. Toyota and Lexus owners are still strongly advised to take out any driver's floor mat and not replace until repairs and reconfigurations have been made. In a statement, Toyota said, "The safety of our owners and the public is our utmost concern and Toyota has and will continue to thoroughly investigate and take appropriate measures to address any defect trends that are identified." According to the LA Times, an Edmunds.com analyst said the gas pedal modifications proposed by Toyota were "viable solutions."

Toyota Recalls 100,000 Tundra Trucks in 20 States due to Corrosion Risk

Federal regulators at the National Highway Traffic Safety Administration announced today that Toyota would recall 110,000 Tundra Trucks from model years 2000 through 2003. The recall only affects vehicles registered in Connecticut, Delaware, Illinois, Indiana, Kentucky, Maine, Maryland, Massachusetts, Michigan, Minnesota, New Hampshire, New Jersey, New York, Ohio, Pennsylvania, Rhode Island, Vermont, Virginia, West Virginia, Wisconsin, and the District of Columbia.

These states use chemical de-icer agents such as road salts to treat roadways and highways during the winter. The salts can cause corrosion to the frame of the truck that can cause damage to the brake system, which could lead to brake failure. Owners of recalled vehicles will be contacted to bring their trucks to a local dealer will the frame will either be replaced, repaired, or a rust-resistant compound will be applied.
