$14 Million Awarded to Victim of Florida Crash Involving Cell Phone Use

gavel-justice.jpgIn personal injury news, a Florida man severely injured in a car accident in 2007 in Melbourne has been awarded $14.4 million, Lawsuits and Settlements reported this month. The plaintiff, Glen Kroeger, 50 at the time, was driving his van when it was struck head-on by a vehicle driven by Christopher Bevis and owned by C&G Homes, Inc. At the time of the collision, Bevis was using his cell phone. He was subsequently convicted of reckless driving.

Kroeger suffered a fractured humerus, a crushed left ankle, and a traumatic brain injury. As a result of his injury, he lost over 110 pounds, and suffers from memory loss and severely impaired speech. His counsel alleged that he has difficulties make decisions and acting appropriately in certain situations. The plaintiff contended that because of his injuries, he will never again be able to return to his work as a air conditioner repairman.

The defendants did not appear at the trial and a default judgment was entered. The court awarded $10.4 million to Kroeger for past and future medical costs, past and future lost earnings and earning capability, and past and future pain and suffering. Kroeger's wife was awarded $4 million for loss of consortium.
